stop condition calculating a deformed mesh, ALE

To prevent inverted mesh elements I use the stop condition "minqual1_ale-0.5". Because of the model-settings for geometry shape Comsol uses first order elements for inverted mesh elements with a tolerance<0.1.
While calculating the solution inverted mesh elements occur, so that future remeshing gets wrong. I think, because of the stop condition there shouldn't be any inverted mesh elements!
How is the algorithm? Should I deactivate using first order elements for inverted mesh elements?
Is there anybody who knows the reason?
